1. Acceptance of Terms

These Terms of Use govern your access to and use of the website belunik.com and all wellness services provided by Belunik Wellness Studio Pty Ltd, ABN 83 947 261 504, owned and operated by Marina Kowalski, at 25 Erskine Street, Sydney NSW 2000, Australia. By visiting our website, creating an account, booking a class, purchasing a membership, or participating in any studio activity, you agree to be bound by these terms in their entirety. If you do not agree with any provision contained herein, you must refrain from using our website and services. We reserve the right to modify these terms at any time, and continued use of our services following the publication of updated terms constitutes your acceptance of those changes. The version of the terms in effect at the time of your booking or purchase shall apply to that specific transaction.

2. Services Description

Belunik Wellness Studio offers group yoga classes, Vinyasa Flow sessions, private coaching, meditation and breathwork workshops, and corporate wellness programs as described on our website and at our physical studio location. Service descriptions, schedules, pricing, and instructor assignments are subject to change without prior notice, although we make reasonable efforts to communicate significant changes to registered clients in advance. All prices are quoted in Australian dollars and include GST unless otherwise stated. Introductory offers, package discounts, and membership rates are valid for the periods specified at the time of purchase and cannot be combined with other promotions unless explicitly permitted. Corporate wellness agreements are governed by separate contracts that supplement these general terms where specific provisions differ.

3. Bookings and Cancellations

Class and session bookings may be made through our website booking form, by telephone at +61292518624, or in person at the studio reception. Confirmation of your booking is sent via email within one business day and constitutes acceptance of the reservation subject to availability. Clients must provide at least twelve hours notice to cancel or reschedule a group class without penalty. Private coaching sessions require a minimum of twenty-four hours notice for cancellation or rescheduling. Failure to provide adequate notice may result in forfeiture of the session fee or a charge equivalent to fifty percent of the session cost. No-shows without prior notification will be charged the full session fee. Membership cancellations require seven days written notice before the next billing cycle and can be submitted via email to belunik@hotmail.com.

4. Health and Safety

Participation in yoga, meditation, and related wellness activities involves inherent physical risks. By using our services, you confirm that you are physically capable of participating and that you have consulted a medical professional if you have any condition that may be affected by exercise. You must inform your instructor of any injuries, medical conditions, pregnancies, or physical limitations before each session begins. Belunik Wellness Studio instructors provide modifications and guidance but cannot guarantee that all exercises are suitable for every individual. You participate voluntarily and assume responsibility for monitoring your own body and ceasing activity if you experience pain, dizziness, or discomfort. Clients under eighteen years of age must be accompanied by a parent or guardian who accepts these terms on their behalf.

5. Liability Limitation

To the maximum extent permitted by the Australian Consumer Law and the laws of New South Wales, Belunik Wellness Studio Pty Ltd, its owner, employees, contractors, and instructors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or participation in our services. Our total liability for any claim related to our services shall not exceed the amount you paid for the specific session or package giving rise to the claim. Nothing in these terms excludes, restricts, or modifies any consumer guarantee or right that cannot be excluded under the Competition and Consumer Act 2010 (Cth). Personal belongings brought to the studio are left at your own risk, and we recommend securing valuables in the provided storage areas during sessions.

6. Intellectual Property

All content on the belunik.com website, including text, graphics, logos, photographs, video recordings, class sequences, and software, is the property of Belunik Wellness Studio Pty Ltd or its content licensors and is protected by Australian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any website content without prior written consent from Marina Kowalski or an authorised representative. Recording of classes through audio, video, or photographic devices is prohibited without explicit instructor permission. The Belunik name, logo, and associated branding elements are registered or common-law trademarks and may not be used in connection with any product or service that is not offered by Belunik Wellness Studio.

7. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of New South Wales, Australia. Any dispute arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of New South Wales. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
